Please see below what we need to do if you have changed your mind and you are no longer able to move into the property.

The replacement tenant process we need to follow differs slightly depending upon how far along the signing process you are.

What do you do if you have changed your mind and your are no longer able to move into the property before signing the tenancy agreement?

If you find you cannot move into the property before you have signed the tenancy agreement, you must speak to the rest of your group as you would all lose your £60 pp admin fees that have already been paid.

What do you do if you have changed your mind and you are no longer able to move into the property after signing the tenancy agreement?

If you have changed your mind and find you cannot move into the property after you have signed the tenancy agreement, it is still your responsibility to:

  • find a replacement tenant.
  • continue paying the rent and utility bills until the replacement tenant has signed the replacement tenancy agreement or deed of assignment.

What steps should you take?

We can help you advertise the room on our website and Rightmove; but you are legally bound by the contract until a replacement has signed.

You need to ensure the remaining tenants are aware.

All the tenants in the house could advertise for a replacement tenant by putting up notices at the University .

There will be a fee of £240.00. We will require this in advance.  Please contact us on 01904 629929 to make this payment.  

 

It is important that the replacement tenant:

  • is a student, otherwise there will be a council tax liability.
  • have someone from the UK who can act as a guarantor.
  • is aware they will need to pay their £300.00 deposit.
  • has been told they will need to pay an admin fee of £60.00. 
  • is aware they will need to pay at least one month’s rent.

What if you change your mind before the tenancy starts?

When we find someone who is interested in the room, we will pass their contact details on to all remaining tenants.  We will ask them to get in touch to arrange to meet with the interested person. We will also arrange a viewing with them. If everyone is happy to go ahead, we will ask all tenants to sign a new contract which will override the contract you have signed.  

If a replacement hasn’t been found before the start of the tenancy, you will remain liable for your share of the rent and utility bills until a replacement tenant has signed. 

Once the new contract has been signed on behalf of the landlord, you will be released. Your deposit will also be refunded. 

What if you change your mind after the tenancy starts?

When we find someone interested in the room, we will pass their contact details on to all remaining tenants.  We will ask them to get in touch to arrange a viewing. If everyone is happy to go ahead, you all need to come into our office to sign a deed of assignment. Once the deed of assignment has been fully signed, you will be released from the contract.  This will be from the date the new tenant takes over.  You will be refunded any rent that you have over paid, along with your deposit (minus any deductions).   

  

Our payment schedules are calculated by percentage.  Therefore the instalments already paid may not reflect the time you have been in the property. Once the replacement has taken over, we will use the daily rate to ascertain if you have over or underpaid. If there is any amount outstanding, we will let you know the amount before you are released.  This will need to be paid before your refund will be processed.
